Differences in guidance from various organisations is preventing uniform standards of practiceThe emphasis in medical law and ethics on protecting the patient’s right to choose is at an all time high. Apart from circumscribed situations, for instance where the Mental Health Act 19831 is applicable, the only justification for medically treating an adult patient against his or her wishes is on the basis of common law, using the principle of best interests, and only when he or she lacks capacity to (...) refuse treatment. As a result, it is important that clinicians should be able to assess capacity to refuse treatment. Given that judgements of incapacity involve deciding that a person does not have the ability to refuse treatment, a great deal of care needs to go into the assessment and characterisation of incapacity.There is divergence between the characterisation of capacity that is used by the courts and that which is recommended by the British Medical Association . The BMA usefully expands on the first element of capacity as set out in the standard legal definition of capacity in the Re C judgment2 but ignores the other two elements. By doing this, the BMA makes it unclear whether it is rejecting these as relevant to capacity; it also misses the opportunity to expand on these elements in a clinically useful way.We will begin with a description of the BMA’s advice3 and the standard English legal definition of capacity.2,4 Then we will show that there are important discrepancies between these two sources of advice. In an attempt to learn from COVID-19, this essay features six responses to the question: what did COVID-19 teach us, expose in us, or purge out of us when it comes to spiritual formation in Christ? Each response was written independently of the others by one of the coauthors. Diane J. Chandler focuses in on how COVID-19 exposed grievous inequities for ethnic groups in the American church and broader society. Kelly M. Kapic reminds us of the goodness of human finitude (...) and how COVID restrictions have forced many of us to embrace our limitations. Siang-Yang Tan reflects on eight lessons he has learned during this pandemic year in his role shepherding a local church. James C. Wilhoit calls us to consider the structures that are needed for local church leadership to make wise and godly decisions in times of crisis. Richard Peace draws our attention to what might be learned from the forced monasticism brought about by COVID-19 quarantines. Finally, Ruth Haley Barton pauses to consider the interdependence of human life that has been dramatically illustrated by this pandemic. While these six responses certainly do not exhaust all there is for the church to learn from COVID, we present them in the spirit of “O Lord, teach us what we do not see” and hope they will inspire your own reflections. A primary aim of our research was to provide empirical grounds on which to stimulate discussion about the nature of decision-making capacity (DMC). Whiting criticizes in particular the concept of (...) 'pathological values' that we suggested might be relevant in the assessment of DMC and in the related issue of deciding when a patient's refusal of beneficial treatment should be overridden.Whiting's central concern is with DMC. Whiting argues that the absence of pathological values should not be a criterion for DMC. We are unclear whether he is also arguing that pathological values do not provide a reason of any kind for overriding treatment refusal. At the end of the paper he writes: "we cannot justify compulsory treatment of patients who have pathological values... on the grounds that these patients lack DMC" (2009, XX). This seems to leave open the possibility that we may be able to justify compulsory treatment of patients who have pathological values on grounds other than that they lack DMC. As we wrote in our response to the discussants of our original paper, "The primary issue for us is whether the reasons for refusal to which we draw attention provide grounds for overriding refusal, and if they do how they can be characterized in such a way as to avoid the ever-present danger of simply overriding autonomy in a patient's best interests" (Tan et al. 2006b, 300).In deciding on whether to use compulsory treatment, there are other relevant factors that may need to be considered, such as the seriousness of the decision, which determines the threshold for competence. However, in this response we consider three issues. First, we argue that the current concept of DMC is by no means so clear cut or generally agreed upon as Whiting implies, and that some of the lack of clarity relates to pathological values. Second, that the concept of DMC is itself dependent on accounts of autonomy, and that it is plausible that pathological values can affect autonomy. Third, we directly consider the question of whether a coherent account of pathological values might be given based on a concept of authenticity.The Current Criteria for DMCWhiting argues that the current criteria for DMC are correct and that an additional criterion along the lines of absence of pathological values should not be added. This argument assumes that there is a clear and agreed understanding of the current criteria. We believe this is not the case for three reasons.(i) Whiting begins his account of DMC by saying that it is normally taken to include: "(1) [End Page 345] understanding (and appreciation)" (2009, 341). Already there is an area of dispute, and the use of parentheses reflects this. The concept of 'appreciation' was developed by Grisso and Applebaum (Grisso, Appelbaum, and Hill-Fotouhi 1997). It is not included in either English common law development, for example (ReC), nor in the criteria specified in the Mental Capacity Act 2005. More important, Grisso and Appelbaum in their comment on our original paper (2006) argue that our work advances thinking about 'appreciation' rather than requiring that we add new elements. The implication is that they believe that what we have called pathological values are relevant to the assessment of capacity and are already included in an account of capacity that incorporates the criterion of 'appreciation.' In our response, we argued that pathological values are not entirely captured within the account of appreciation that Grisso and Appelbaum had previously given. The title John Kekes has given to his book accurately describes its contents. The book is devoted to the development and defense of an original, complex, and persuasive theory of rationality, whose goal is to provide both a theoretical and a practical alternative to skepticism. To accomplish this purpose, Kekes believes, it is necessary to show that standards of rationality can be justified without either lapsing into arbitrariness or becoming entrapped in a vicious regress.

Capacity and competence in the field of child and adolescent psychiatry are complex issues, because of the many different influences that are involved in how children and adolescents make treatment decisions within the setting of mental health. This article will examine some of the influences which must be considered, namely: developmental aspects, the paradoxical relationship between the need for autonomy and participation and the capacity of children, family psychiatry, and the duty of care towards children and adolescents. The legal frameworks (...) relevant to consideration of consent and competence will be briefly considered, as well as some studies of children's consent, participation and competence. A case vignette will be used as a focus to consider the complexity of the issue of competence in child and adolescent psychiatry, in the particular mental disorder of anorexia nervosa. (shrink)

The spatial dynamics of the optical emission from an array of 50 times 50 individual microcavity plasma devices is investigated. The array is operated in argon and argon-neon mixtures close to atmospheric pressure with an ac voltage. The optical emission is analysed with phase and space resolution. It has been found that the emission is not continuous over the entire ac period, but occurs once per half period. Each of the observed emission phases shows a self-pulsing of the discharge, with (...) several bursts of emission of fixed width and repetition rate. The number of emission bursts depends on applied voltage and frequency. Spatially resolved measurements prove that the emission bursts are formed by overlapping emission pulses from single discharge cavities. Today, an increased impact of information and communication technologies in the society at large has lead teachers to engage in professional development activities related to the use of ICT. Even though this development has been prominent for more than two decades, its long term effects seem complex to determine. This paper is based on interviews with twelve Swedish teachers who participated in a national program for promoting school development and use of ICT in 2000-2001. The program was aligned with the (...) pedagogical approaches set out in the national Swedish curriculum, such as a shift from teaching to learning and giving pupils more responsibility, introducing interdisciplinary approaches to teaching in teams, and a problem based pupils-oriented pedagogy. The analysis of the interviews show that teachers still feel a high degree of appreciation for the program, and that they share a relative agreement of the importance of the program for their teaching with ICT in the last decade. The general intentions of the program to be more concerned with school development and pedagogy rather than technology and ICT seem also to be present today as a long term effect. (shrink)

This book is an exercise in hermeneutics, or interpretation. In it Professor Rasmussen is concerned with an explanation of symbols and the myths in which they occur. Using the methods of phenomenology and taking advantage of the results of earlier interpreters of myths and symbols, particularly Eliade and Ricoeur, he develops and defends a view of symbolic language whose main theses include the following. Symbols and, thus, myths are authentic representations of a unique dimension of human consciousness, which can be (...) articulated only through them. A necessary expression of human experience, they represent man’s attempt to probe the ultimate foundations of meaning. The author illustrates these theses by an examination of symbolic language as it appears primarily in religious, but also in literary, social, and political discourse. The discussion is largely pre-philosophical, in the sense that little attention is given to the central epistemological question: Are the myths in which symbolic language occurs true? To the extent that the author addresses this question, the answer he gives appears to imply a relativistic skepticism. For example, he writes: "Reality is an individual and social construction". From the perspective of philosophy, this is the most important point made in the book; but it needs to be pursued much further than Rasmussen has done. (shrink)

Aristotle's doctrine of the mean is not a counsel to perform mean or moderate actions. It states that excellence of character is a mean state with regard to the having and displaying of emotions. All emotions are morally neutral; character is shown by displaying emotions on the right occasions, Not too often or too rarely, Not too strongly or too weakly, For sufficient and only sufficient reasons, Etc. Hegel's main problem derived from reflection on the tradition since Descartes in which the problems of the search for certain knowledge and the relation of mind to matter were dominant. If the question is pressed further even into extraphilosophical problems there can be detected a desire to demonstrate the realm of something personal, the presence of and communication with others, thus demonstrating the unreality of isolation, loneliness, and depression, the solipsism that is the philosopher's ultimate belief.

Originally published in 1968, this book traces the development of the emotive theory of ethics from its outline by Ogden and Richards in The Meaning of Meaning to the elaborate presentation by Stevenson in Ethics and Language. Attention is paid to the positive features of the ethical theory whilst the author also shows how a more adequate view can be reached through critical reflection on it.

A Satisfactory discussion in depth of all the philosophical problems that could be raised concerning musical representation would require much more space as well as more ability than I have at my disposal. Nobody should believe, or believe that I believe, that what follows is more than a rather sketchy examination of a few central issues.

A distinction between ‘activities’ and ‘processes’ plays an important role in Aristotle's argument to establish that the good life is a life of activities, among which metaphysical contemplation is foremost. But, as a result of having failed to distinguish internal from external ends of action, Aristotle makes fallacious inferences from every activity's having an internal end in itself to its possessing features which may be legitimately inferred only from external ends, and from every process's having an internal end that is (...) its terminal point to its having the attainment of that terminal point as an external end. As leadership discourses in higher education are increasingly being mediated online, texts previously reserved for staff are now being made available in the public domain. As such, these texts become accessible for study, critique and evaluation. Additionally, discourses previously confined to the written domain are now increasingly multimodal. Thus, an approach is required that is capable of relating detailed, complex multimodal discourse analyses to broader sociocultural perspectives to account for the complex meaning-making practices that operate in online leadership discourses. For (...) this purpose, a digital multimodal discourse approach is proposed and illustrated via a small-scale case study of the online leadership discourse of an Australian university. The analysis of two short video texts demonstrates how a digital multimodal discourse perspective facilitates the identification of key multimodal systems used for meaning-making in online communication, how meaning arises through combinations of semiotic choices, and how the results of multimodal discourse analysis using digital technology can reveal larger sociocultural patterns – in this case, divergent leadership styles and approaches as reflected in online discourse, at a time of immense change within the higher education sector. Human languages typically employ a variety of spatial metaphors for time (e.g., “I'm looking forward to the weekend”). The metaphorical grounding of time in space is also evident in gesture. The gestures that are performed when talking about time bolster the view that people sometimes think about regions of time as if they were locations in space. However, almost nothing is known about the development of metaphorical gestures for time, despite keen interest in the origins of space–time metaphors. In this (...) study, we examined the gestures that English‐speaking 6‐to‐7‐year‐olds, 9‐to‐11‐year‐olds, 13‐to‐15‐year‐olds, and adults produced when talking about time. Participants were asked to explain the difference between pairs of temporal adverbs (e.g., “tomorrow” versus “yesterday”) and to use their hands while doing so. There was a gradual increase across age groups in the propensity to produce spatial metaphorical gestures when talking about time. However, even a substantial majority of 6‐to‐7‐year‐old children produced a spatial gesture on at least one occasion. Overall, participants produced fewer gestures in the sagittal (front‐back) axis than in the lateral (left‐right) axis, and this was particularly true for the youngest children and adolescents. Gestures that were incongruent with the prevailing norms of space–time mappings among English speakers (leftward and backward for past; rightward and forward for future) gradually decreased with increasing age. This was true for both the lateral and sagittal axis. This study highlights the importance of metaphoricity in children's understanding of time. It also suggests that, by 6 to 7 years of age, culturally determined representations of time have a strong influence on children's spatial metaphorical gestures. (shrink)

Instrumentalism is an approach to science that treats a theory as a tool and only as a tool for computation; it dispenses with the concept of truth.Conventionalism treats a theory as true by convention if it forms a pattern of observations from which correct predictions can be made.Operationalism denies meaning to the concepts of a theory unless they can be defined operationally. It is argued in this paper that truth-value is indispensable to science, because a theory can be rejected only (...) if an empirical consequence is false and if falsity of a conclusion entails falsity of a premise. This undermines the above positions. The fourth interpretation isinduction. Induction, by contrast, uses the notion of truth-value. What is focused on here is its reliance on the ultimacy ofobservation. The present thesis is that instrumentalism, conventionalism, and induction are different attempts to handle observations. The common problem is the gap between data and theory.All these interpretations share a philosophy of observationalism. The aim of this paper is to show that the several orthodox interpretations of science all fail to solve the problem of the data-theory gap, and to show that they all presuppose a philosophy of observation. Conflicting Systems in the History of Philosophy. Hegel's logic consists, as is well known, in a chain of categories, connected by a relation of dialectic, which proceeded from the featureless Being, Nothing, and Becoming through more important ones such as Substance, Cause, and Reciprocity to the highest category of all, the Absolute Idea. Now Hegel also pointed to an interesting correlation between the categories of his logic and the dominant concepts of those philosophies that preceded his own: that is to (...) say, the logical order of categories given by him corresponded to the temporal order of the history of philosophy. Such connexion was not, however, to be regarded as an accident but as a necessary truth: for the Absolute manifested itself temporally in the form of the history of philosophy. Seeing that this contention probably contains some psychological truth and is probably assumed in Marxian interpretations of Hegel, it may be of some interest to see how far it can be substantiated. The problem to be discussed here concerns ontology so far as it may not be formed by scientific theory. In brief terms, the problem arises in the following way. On the one hand, the world surely consists of whatever is there, irrespective of whether human beings are around or not, and irrespective especially of whether human beings have constructed any scientific theories depicting the nature of the world; on the other hand, scientific theories are subject to the limitation that we (...) can never verify them or prove them to be true, so that the ontology prescribed by scientific theory is not firmly established but is only what is attributed to the world by a fallible scientific theory at any given time.
